Terms of Service

These terms govern your use of thinkelevated.com (the "Site"). They do not govern paid engagements with Think Elevated LLC — those are covered by a separate Master Services Agreement signed before any work begins. If the two ever conflict on a paid engagement, the MSA wins.

By using the Site you agree to these terms. If you don't agree, please don't use the Site.

1. Who we are

The Site is operated by Think Elevated LLC, a Delaware limited liability company located at 254 Chapman Rd, Ste 208 #18259, Newark, DE 19702, USA. References to "we", "us", and "our" mean Think Elevated LLC.

2. What the Site is

The Site is an informational marketing surface for Think Elevated's services. It does not constitute an offer to provide any specific service, and any pricing shown is indicative — final terms for any engagement are written into an MSA and Statement of Work agreed by both parties.

The contact form is the start of a conversation, not a contract.

3. Acceptable use

You agree not to:

Use the Site for any unlawful purpose, or in violation of any applicable US, state, or foreign law
Scrape, crawl, or mass-download Site content beyond what is allowed by robots.txt, except for indexing by mainstream search engines
Submit false, malicious, or automated content through the contact form
Attempt to access non-public areas of the Site (the /admin/* paths), including by exploit, credential stuffing, or social engineering
Reverse-engineer, decompile, or attempt to extract source code from the compiled Site bundle, except as expressly permitted by law
Use the Site to transmit malware, run denial-of-service attacks, or fingerprint other visitors
Misrepresent your affiliation with any person or organisation, including impersonating a representative of Think Elevated

We may suspend your access without notice if we reasonably believe you have violated these terms.

4. Intellectual property

All content on the Site — copy, photography, illustration, code, design system, brand marks, and the trade name Think Elevated — is owned by Think Elevated LLC or its licensors and protected by US and international intellectual property law.

You receive a limited, revocable, non-transferable, non-exclusive licence to view the Site in a standard web browser for personal, non-commercial reference. All other rights are reserved.

Quoting short excerpts of our writing for commentary, criticism, or news reporting (fair use) is fine. Republishing entire pages, components, or the design system is not.

5. Open-source components

Parts of the Site are built on open-source libraries (Nuxt, Vue, GSAP, and others). Each library is governed by its own licence; those licences are not affected by these terms.

6. Third-party links

The Site may link to third-party websites or services. We don't control them and we're not responsible for their content, policies, or practices. Following a link is at your own risk.

7. Disclaimer of warranties

The Site is provided "as is" and "as available", with all faults and without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

We do our best to keep the Site online, accurate, and free of malware, but we do not guarantee any of those outcomes. Information on the Site may become out of date.

8. Limitation of liability

To the maximum extent permitted by law, Think Elevated LLC will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with your use of the Site, including without limitation lost profits, lost data, lost goodwill, or business interruption, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of these terms or your use of the Site is capped at one hundred United States dollars ($100).

This limitation does not apply to liabilities that cannot be limited under applicable law (such as gross negligence, willful misconduct, or fraud).

9. Indemnification

You agree to indemnify and hold harmless Think Elevated LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these terms or your misuse of the Site.

10. Privacy

Use of the Site is also governed by our Privacy Policy and Cookie Policy.

11. Governing law and venue

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these terms shall be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to the personal jurisdiction of those courts.

If you are a consumer based in the European Union or United Kingdom, nothing in this section deprives you of mandatory consumer-protection rights in your country of residence.

12. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top will change, and for any material change we'll surface a notice on the homepage for at least 30 days. Continued use of the Site after the new terms take effect constitutes your acceptance of them.
